Podcasting and Fair Use.?

Legal question here.

So I want to make a talk-show podcast (audio only). I don't want to have advertisement. I just want to do it for fun. If I played short clips of copyrighted music during segments (probably less than a minute long) can I get in trouble? Is that covered under fair use? I may use some music to fade into new segments and I may be talking/critisizing some music as well (I believe that's covered under fair use).

Can I use copyrighted music for intros? Can I play a clip so that I may critisize and make comments about it? How much trouble can I get into if I wind up infringing copyright?

Basically yes, you are violating copyrights by using the music as intro/outro music, segues, etc. Not sure about the critiquing element. Here's a link to a good book (I don't benefit from sharing the link) by lawyer and podcaster Gordon Firemark that might be of assistance. http://www.podcastlawbook.com/

You can't claim fair use for a podcast unless you use short clips as part of a review.
